Terms of Service

1. Acceptance of Terms

By accessing or using the website at www.thefencingroom.com and any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and The Fencing Room OG, Imbergstraße 23, 5020 Salzburg, Austria ("we", "us", "our", or "The Fencing Room").

2. Description of Service

The Fencing Room is a premium video coaching platform delivering structured fencing instruction from internationally experienced coaches. Content covers technique, tactics, mental performance, athletic conditioning, nutrition, equipment, and more.

We offer the following subscription plans:

All prices are exclusive of applicable tax. Tax is calculated and added at checkout via Stripe Tax.

We reserve the right to modify, suspend, or discontinue features of the Service at any time with reasonable notice.

3. Payment & Billing

IMPORTANT — AUTOMATIC RENEWAL NOTICE: All paid subscription plans automatically renew at the end of each billing period (monthly or annually) at the then-current rate until you cancel. You will be charged on the same date each billing cycle. By completing your purchase, you authorize The Fencing Room OG to charge your payment method on a recurring basis. You may cancel at any time before your next renewal date to avoid being charged for the next period.

All payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis in accordance with your chosen plan.

• —All prices are displayed and billed in US Dollars (USD).
• —Subscriptions renew automatically at the end of each billing period until cancelled.
• —You are responsible for ensuring your payment information remains accurate and up to date.
• —Failed payments may result in suspension of access until payment is resolved.
• —We may change subscription prices at any time with at least 30 days' advance notice. Continued use of the Service after the price change takes effect constitutes acceptance of the new price.

4. Cancellation

You may cancel your subscription at any time using one of the following methods:

• —Online: Log in to your account at www.thefencingroom.com, go to My Account → Manage Subscription, and follow the cancellation steps.
• —Email: Send a cancellation request to info@thefencingroom.com with the subject line “Cancel Subscription” and include the email address associated with your account.

Cancellation takes effect at the end of your current billing period. You will retain full access to the Service until the end of your paid period. There are no cancellation fees. Founder's Circle subscribers who cancel will lose their lifetime rate and will not be able to re-subscribe at that rate.

5. Refund Policy

No refunds are provided except where required by applicable law. If you believe you are entitled to a refund under applicable law (including, where applicable, EU consumer protection regulations or US state law), please contact us at info@thefencingroom.com and we will review your request promptly.

6. Content & Intellectual Property

All video content, text, graphics, logos, and other materials published on The Fencing Room are the exclusive property of The Fencing Room OG or its content partners and are protected by Austrian and international copyright law.

• —Your subscription grants you a personal, non-transferable, non-exclusive licence to access and view content for private, non-commercial use only.
• —You may not download, record, reproduce, redistribute, resell, broadcast, or otherwise share any content from the platform.
• —Sharing account credentials with others is prohibited. Each subscription is for one individual user.
• —Any unauthorised use of our content may result in immediate account termination and legal action.

7. User Accounts

To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for:

• —Maintaining the confidentiality of your account credentials.
• —All activity that occurs under your account.
• —Notifying us immediately at info@thefencingroom.com if you suspect unauthorised access.
• —You may sign in using your email and password or via Google OAuth. You are responsible for the security of your chosen sign-in method.
• —Your profile may include a nickname, avatar image, and date of birth. This information is stored securely and used solely within the platform.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Account Deletion

You may permanently delete your account at any time from your account settings. Account deletion will:

• —Permanently remove all your personal data, profile information, and avatar from our systems within 30 days.
• —Immediately cancel any active subscription. No refund will be issued for the remaining subscription period.
• —Remove access to the Service immediately upon deletion.

Billing records may be retained for up to 7 years as required by Austrian tax law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, The Fencing Room OG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Dispute Resolution (US Users)

For users based in the United States, we encourage you to contact us first at info@thefencingroom.com to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring individual claims in small claims court.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial. This arbitration clause does not apply to users resident in the European Union.

11. Governing Law

These Terms are governed by the laws of the Republic of Austria, in particular the Allgemeines Bürgerliches Gesetzbuch (ABGB), without regard to its conflict of law provisions.

Where applicable, EU consumer protection regulations — including the Consumer Rights Directive (2011/83/EU) and the ADR Directive (2013/11/EU) — apply to consumers resident in the European Union.

For customers based in the United States or other non-EU jurisdictions, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Salzburg, Austria.

The European Commission provides a platform for online dispute resolution (ODR) available at ec.europa.eu/consumers/odr. We are not obliged to participate in ADR proceedings but may do so at our discretion.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the website before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must cancel your subscription before the changes take effect.
